Dristion Kurti, accused of relations with a minor, is released – The court takes into account the tradition of the Roma community

The District Court has ordered the release of Dristion Kurti, who had been arrested and was under investigation for a relationship with a 13-year-old girl, with whom he had fathered a child. The case sparked widespread public debate due to the girl’s age and the legal sensitivity of the matter.
However, the court decided to release him, taking into account mitigating circumstances and especially the cultural and traditional context of the Roma community, of which both parties are members.
According to the court decision, the relationship was accepted by both families and considered a “traditional marriage,” which, although conflicting with the Albanian Penal Code, is treated differently within the community where it took place. The court acknowledged a complete lack of criminal awareness on the part of the young man and emphasized the need for social intervention and education, rather than penal punishment.
Child rights organizations have reacted to the decision, considering it a dangerous precedent that could legitimize underage marriages. Meanwhile, representatives of the Roma community are calling for more dialogue with institutions to address conflicts between state law and their traditions.
